Land Case: Court Finally Decides As FUTO Floors Anukam

The tide finally and legally turned against Mr Sam Anukam and Ors as they are disgraced as illegal occupants, land grabbers and encroachers by a recent court judgment at the Imo State High Court, Portharcourt Road, Owerri.

The over six years legal fireworks ignited by Mr Sam Anukam, against both the Federal and Imo State government, its agencies and private partners, that include but not limited to Federal University of Technology Owerri (FUTO) and Orient Garden City among others, over the legitimate owners of the embattled FUTO land, has been extinguished by the landmark judgment delivered by Hon Justice K.K Orjiakor against the plaintiff, Sam Anukam and ors.

Consequently, upon careful consideration of the suit, and with the Statement of Claim, Witness Depositions, Statement of Defence and other processes filed, thereto and the defence of the defendants and after considering the evidence of the Claimants and
Defendants, the court holds that the case of the Defendants succeeds as the rightful owner of the land in question.

Delivering the judgment, Hon Justice Orjiakor averred that Sam Anukam and ors were incompetent in filing the matter and dismissed the suit totally as an abuse of court process, as court records have it that the same suit has been earlier handled and judgment delivered by Hon Justice Njemanze.

Another straw that broke the plaintiff camel’s back which should be considered the import of the judgment, was that the said Sam Anukam as an attorney cannot sue in his behalf because those communities he claims to represent are non juridic persons, they have to nominate someone to sue on their behalf and not him (Anukam) suing in his own name.

Speaking to the newsmen after the judgment both the counsel to Orient Garden City Limited Barr Stanley U Okwara PhD and the Public Relations Officer (PRO) of FUTO Mrs Joy Nnodi on behalf of their Establishments expressed satisfaction on the judgment.

Speaking further, Barr Okwara PhD averred that one of the major significance of the judgment will be the return of peace and conducive atmosphere and environment for all defendants to be focused on their primary assignments of securing and developing all FUTO lands for the collective benefits of both Students, Management, host communities and the general public.

Every effort to get the response of the Plaintiff or their representatives proved abortive as neither Sam Anukam nor his representing counsel, Barr LUN Nwakaeti was noticed within the court premises.

As Governor Hope Uzodinma of Imo State is making consideration to appoint new LGAs council Chairmen in the state in no distant time, a fresh facts have emerged on how an ex- Governor’s aide Hon. Ifeanyi Oruh who is currently the commissioner for Rural Development and Empowerment that coordinated one of the Governor’s support Groups known as. ” GOVERNOR’S MONITOR” during the last Imo state Governorship election is making frantic efforts to lure and convince
His Excellency Governor HOPE Uzodimma into accepting to appoint and use members of the Structure “THE GOVERNORS LGA MONITOR” as the incoming LGA Council Chairmen of the 27 LGAs of Imo State, as against the usual privilege the Governor gives Political Leaders of the party in the LGAs to appoint credible persons for such position. Not minding the consequence of such or whose odd is gored according to inside source
It is therefore on the above premise that majority of the said monitors have already started parading themselves at several quaters as the incoming council Chairmen in their various LGAs of the state as promised and assured by Hon. Oruh even when the Governor has no done so.
The implication now is that, should Governor Uzodinma give approval to the said proposal, political leaders across the state who have been supporting the Governor and who toyed day and night to see that the Governor was re elected for the second term will not have inputs or say of who becomed their next council chairman. In other words the likes of Chief Tony Chukwu, Charles Amadi, Ikedi Ohakim, Marcon Nlemigbo, Marcdonald Ebere, Maurice Iwu, etc as well as Federal and state lawmakers of Imo State extraction will be excluded in taking such decision of who is their in coming council Chairmen.
In a reaction to the development, a group known as IMO DEMOCRACY ADVANCEMENT GROUP “IDAG” in a press statement signed by its National Coordinator Comdr Marvelous Ike Esq and Secretary Dr Johnson Ilo which was made available to newsmen, discribed Oruh’s proposal as undemocratic and wicked..
Expressing dismay over the issue, the group however argued. that most of the said Monitors are not even members of APC before the 2023 election neither have they contributed or paid their dues in any way to uplift the party in the LGA.they further argued that there is no doubt that the said party leaders in the LGAs do not know these monitors as party members or stakeholders, to qualify for such appointment and recognition by the Governor.What this means is that the party leaders in the LGAs will not know how the Council Chairmen will emerge or be appointed by the Governor except the said Hon Commissioner Ifeanyi Oruh as currently speculated.
They equally submitted that over 170 certified support Groups worked for the Governor’s victory in 2023 and why giving consideration to a single group
The group is therefore using this opportunity to urge His Excellency Gov HOPE Uzodimma not to accept such proposal to ignore leaders of the party in the LGAs in the appointment of the said council Chairmen as that will amount to neglecting them and their efforts in building and sustaining the party in their respective LGAs of the state.
However, all efforts made to reach Ifeanyi Oruh to get his own side of the story proved abortive as his number was switched off at the time of filing this report.
